THE MAXIMUM LIABILITY OF PFA IN ALL REGARDS IS LIMITED TO FEES (EXCLUDING EXPENSES) PAID BY CLIENT FOR THE SERVICES PROVIDED WITH RESPECT TO THE RELEVANT SCHEDULE OF SERVICES. Moreover, no action, regardless of form (excluding actions by PFA for nonpayment), arising out of the transactions under this Agreement may be brought by either party more than one year after the cause of action has occurred.

Limited Warranty.  Client acknowledges and understands that PFA is not in the business of providing legal, tax, or investment advice. No information provided by PFA is intended or should be construed as any advice, recommendation or endorsement from PFA as to any legal, tax, investment or other matter. Client independently must evaluate the merits and risks associated with the Services provided and any associated advice provided by PFA. In the event of a breach of this warranty and as the sole and exclusive remedy for any such breach, PFA shall re-perform the Services to bring them into compliance with this warranty. Any claim for breach of this warranty must be made by written notice to PFA at the above address within one year of performance of the Services with respect to which the claim is made.
